Affiliate Program Terms & Policy

These terms govern participation in the ViralDM Affiliate Program. By signing up as an affiliate, you agree to these rules.

1. Eligibility

• You must be 18 years or older.
• You must have a valid ViralDM account.
• You must have a legitimate channel (Instagram, YouTube, blog, email list, etc.) to promote ViralDM.

2. Commission Structure

• 0-9 referrals: 30% recurring commission
• 10-24 referrals: 35% recurring commission
• 25+ referrals: 40% recurring commission

Commissions are recurring — you earn for as long as your referred user remains a paying customer.

3. Cookie & Attribution

• Cookie duration: 90 days from first click
• If a user signs up within 90 days of clicking your referral link, the sale is credited to you
• Last-click attribution: if multiple affiliates referred, the most recent one wins

4. Payout Terms

• Minimum payout: ₹1,000
• Payouts processed monthly on the 5th of each month
• Payment methods: UPI or Indian bank transfer (NEFT/IMPS). We do not currently pay out internationally.
• Commissions become payable as soon as the referred payment is confirmed, and are clawed back if that payment is later refunded (see section 6)

5. Prohibited Activities

• ❌ Self-referral — You cannot use your own code to sign up another account you control
• ❌ Spam — Mass-emailing unsolicited contacts, comment spam, forum spam
• ❌ Misleading claims — False feature claims, unrealistic income promises
• ❌ Trademark bidding — Buying paid ads on "ViralDM" or related trademarks on Google/Bing
• ❌ Coupon/cashback sites — Reselling your commission as cashback to users
• ❌ Fake signups — Creating fake accounts to claim commissions
• ❌ Cookie stuffing — Forcing referral cookies via popups, iframes, or hidden elements
• ❌ Brand impersonation — Pretending to be official ViralDM
• ❌ Multiple accounts — One person, one affiliate account

6. Refund Clawback

If a referred payment is refunded, the corresponding commission is clawed back automatically when our payment processor notifies us — whether or not it has already been included in a payout (in which case it is deducted from your next payout).

7. Tax Compliance (India)

• You are responsible for declaring affiliate income on your ITR
• Tax will be deducted at source where the Income-tax Act, 1961 requires it (Section 194H, at the rate then in force), and a TDS certificate provided
• If you have GST registration, you may invoice us with applicable GST

8. Tracking & Disputes

• ViralDM's tracking system is final for commission attribution
• Disputes must be filed within 30 days of the transaction
• We will investigate but cannot guarantee commissions for transactions that don't appear in our system

9. Termination

Either party may terminate this agreement at any time. Upon termination:

• Your referral link will be deactivated
• Any earned commissions above ₹1,000 will be paid in the next regular payout
• Commissions below ₹1,000 may be forfeited
• Violations may result in forfeiture of all pending commissions

10. Changes to Program

ViralDM reserves the right to modify commission rates, payout terms, or program rules with 30 days notice via email to registered affiliates.

11. Liability

ViralDM is not liable for any losses, damages, or claims arising from your participation in the affiliate program. Maximum liability is limited to commissions actually earned but unpaid.

12. Governing Law

This agreement is governed by Indian law. Disputes will be resolved by competent courts in India.
